Terms of Service
Last updated: June 12, 2026
- • TikData turns publicly broadcast TikTok LIVE activity into analytics. We are not affiliated with TikTok.
- • You must be 18+ and keep your account credentials to yourself.
- • The $10 Week Pass never auto-renews. Monthly plans renew until you cancel; cancelling keeps your access until the end of what you’ve paid for. Fees are non-refundable.
- • Use the data to grow your streams — never to harass, stalk, dox, or pressure anyone, and don’t resell or republish it.
- • Live data is messy: numbers can be incomplete, delayed, or estimated. Dollar figures are estimates, not payout statements.
- • Questions? [email protected].
This summary is for convenience — the sections below are the agreement.
1. Agreement to these Terms
These Terms of Service (the “Terms”) are a binding agreement between you and TikData (“TikData”, “we”, “us”). By creating an account, purchasing a plan, or otherwise using tikdata.live or app.tikdata.live (together, the “Service”), you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a company or agency, you confirm you have authority to bind that organization, and “you” includes it. If you do not agree, do not use the Service.
2. What TikData is (and isn’t)
TikData provides analytics derived from publicly broadcast TikTok LIVE activity — gifts, viewers, battles, and related signals for the creators you choose to track — together with tools such as gifter profiles, timing analysis, rankings, and reports.
TikData is an independent product. We are not affiliated with, endorsed by, or sponsored by TikTok or its operator. “TikTok” and related marks belong to their owners; we use them only to describe what the Service does. TikData does not access private accounts, private messages, or any non-public information.
You are responsible for your own compliance with TikTok’s terms and policies in how you run your TikTok account and how you act on insights from the Service.
3. Eligibility & accounts
You must be at least 18 years old and able to form a binding contract. You agree to provide accurate account information and keep it current. You are responsible for safeguarding your credentials and for all activity under your account — tell us promptly at [email protected] if you suspect unauthorized use. Accounts are for a single customer (one person or one organization); credentials may not be shared outside your organization or used to operate a service bureau for third parties.
You may track any creator within your plan’s limits, including channels you do not own. You are solely responsible for your tracking choices and for how you use the resulting data, including any obligations you may have to the creators or communities involved.
4. Plans, billing & refunds
Week Pass. The Week Pass is a one-time purchase that grants full creator access for 7 days. It never auto-renews — it simply ends.
Monthly plans. Creator and Agency plans bill monthly in advance through our payment processor (Stripe) and renew automatically until cancelled. You can cancel anytime from Settings; cancellation stops future renewals and your access continues until the end of the period you’ve already paid for. We do not offer free trials.
Refunds. Except where required by law, all fees are non-refundable, including for partial periods, unused time, downgrades, or accounts terminated for violating these Terms. The Week Pass exists so you can evaluate the Service inexpensively before committing to a monthly plan.
Price changes. We may change plan pricing or features with notice (e.g., email or in-app); changes apply from your next renewal. Failed payments may result in suspension of access until payment succeeds. You are responsible for any taxes that apply to your purchase.
5. Acceptable use
The Service gives you insight into real people’s public activity. You agree to use it responsibly. You must not:
- use any data from the Service to harass, stalk, threaten, dox, shame, or exert pressure on any gifter, creator, or other person, or to contact gifters in ways they haven’t invited;
- resell, republish, publicly post, or redistribute data or reports from the Service, or use them to build or assist a competing product;
- scrape, crawl, or bulk-export the Service; probe or bypass rate limits, authentication, or entitlements; or access data for creators outside your plan;
- reverse engineer, decompile, or attempt to derive the Service’s sources, methods, or underlying data feeds;
- share accounts outside your organization, misrepresent who you are, or create accounts by automated means;
- use the Service to violate any law, any third party’s rights, or TikTok’s rules in a way that creates risk for us.
We may investigate suspected violations and may suspend or terminate accounts that break these rules (see Section 10).
6. Data accuracy & estimates
Live-stream data is inherently noisy. Analytics depend on real-time capture from public broadcasts, and capture can be affected by TikTok changes, network conditions, regional restrictions, and outages. Data may be incomplete, delayed, duplicated, estimated, or missing, and historical data from before you started tracking a creator generally cannot be recovered. We work hard to make the data excellent, but we do not warrant its accuracy or completeness.
All currency figures (coin, diamond, and dollar values, earnings, and projections) are estimates based on public rates and statistical models. They are not payout statements, accounting records, or financial advice, and actual amounts paid by TikTok can differ. Do not rely on the Service as your sole basis for financial, contractual, or personnel decisions.
7. Service availability & changes
We aim for high availability but provide no uptime guarantee or SLA. The Service depends on third-party platforms and providers we don’t control; if TikTok or a provider changes, limits, or blocks the signals the Service relies on, features may degrade or become unavailable, temporarily or permanently. We may add, change, or remove features at any time. Where a change materially reduces what you paid for, your remedy is to cancel future renewals.
8. Your data & our analytics
Your inputs. You keep ownership of the information you put into the Service (roster choices, notes, tags, account details). You give us the permission needed to process it to run the Service.
Our analytics. The Service’s data, profiles, scores, models, and reports are TikData’s. While your account is in good standing, you have a non-exclusive licence to use the analytics and exported reports for your (or your organization’s) internal business — managing your streams, creators, and gifter relationships. This licence does not permit public republication or resale.
Aggregated data. We may use data in aggregated or de-identified form (never identifying you or your roster) to improve and operate the Service, and may retain such aggregates after your account closes.
9. Intellectual property
The Service — including its software, design, databases, models, and content (other than your inputs) — is owned by TikData and protected by intellectual-property laws. Except for the licence in Section 8, no rights are granted to you. Feedback you send us may be used without restriction or obligation.
10. Suspension & termination
You may stop using the Service and cancel renewals at any time from Settings. We may suspend or terminate your access (with or without notice) if you breach these Terms, if your use creates legal or security risk, if required by law, or if we discontinue the Service. If we terminate without cause while you have paid-up time remaining, our sole obligation is to refund the unused portion of the current period — this is the only exception to Section 4’s no-refund rule.
After termination, your right to use the Service ends and we may delete account data after a reasonable period (see the Privacy Policy for retention). Sections that by their nature should survive (including 6, 8, 9, 11–14, and 16) survive termination.
11. Disclaimer of warranties
THE SERVICE AND ALL DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) TIKDATA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY; AND (b) TIKDATA’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limits apply regardless of the theory of liability and survive failure of any limited remedy. Where the law does not permit a limitation, it applies to the fullest extent permitted.
13. Indemnification
You will defend and indemnify TikData against claims, damages, and reasonable costs (including legal fees) arising from: your use of the Service or its data; your tracking choices; your violation of these Terms or of any law or third-party right; or disputes between you and any creator, gifter, agency, or other third party. We may assume the defence of any matter subject to indemnification, in which case you agree to cooperate.
14. Governing law & disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules.
Talk to us first. Before starting any formal proceeding, you agree to email [email protected] with a description of the dispute and give us 30 days to work it out with you in good faith. Most issues are resolved this way.
No class actions. To the extent permitted by law, disputes will be resolved only on an individual basis — you waive any right to participate in a class, collective, or representative action against TikData. Either party may bring an individual claim in a small-claims court of competent jurisdiction.
15. Changes to these Terms
We may update these Terms from time to time. For material changes we’ll give notice (e.g., email or an in-app message) before they take effect; non-material changes take effect when posted with an updated date above. Continuing to use the Service after changes take effect means you accept them. If you don’t agree, cancel your renewals and stop using the Service.
16. General
These Terms (with the Privacy Policy) are the entire agreement between you and TikData about the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of the Service. Nothing in these Terms creates a partnership, agency, or employment relationship.
